Session 2 of CryptoUK’s ‘Lunch and Learn’ series was focused on cryptoasset classification – what it means, and how to get through the compliance maze.

As a new asset class, crypto challenges many traditional norms of financial regulation, including how to classify cryptoassets for regulatory purposes. (Are they securities? Are they commodities? Are they neither/ both?).

In the EU, the Markets in Crypto-Assets Regulation (“MiCA”) will shortly require crypto-asset issuers and service providers to classify cryptoassets.

During this session, we discussed:

  • what cryptoasset classification means, and why it’s important;
  • what are the MiCA requirements, and how they compare to other jurisdictions;
  • how firms can take a proactive approach to complying with classification requirements under MiCA and other regulatory regimes.
